Dashcams and your car insurance in the Netherlands: do they count as evidence?

A collision happens in an instant, and then it's your word against the other driver's. A dashcam captures exactly what happened, beyond dispute. But how does it work legally? Do dashcam recordings count as evidence in the Netherlands, and what does your insurer think? We explain.

Are dashcam recordings allowed as evidence?

Yes. In the Netherlands, dashcam footage is in practice accepted as evidence, both with your insurer and in any court case. You are allowed to film the public road and use the footage to support your own legal position. Many insurers, and even the police, now take dashcam footage seriously when assessing an accident.

Does a dashcam help establish who's at fault?

Absolutely. The biggest benefit is quickly and objectively establishing liability. Clear footage showing number plates, speed and GPS location often makes discussion unnecessary. Do you get a discount on your premium?

In the Netherlands, most insurers do not (yet) offer a standard premium discount for a dashcam, as happens in some other countries. Even so, a dashcam can save you money indirectly: it prevents you from being wrongly blamed, and the resulting loss of your no-claim discount.

Mind the privacy rules (GDPR)

If you use the footage purely for personal purposes — for example as evidence in case of damage — you fall under the so-called household exemption of the GDPR. Don't simply share footage publicly (such as on social media) showing identifiable people or number plates, as stricter rules then apply.
