Terms of service
Article 1: General
1.1 These general terms and conditions apply to all offers, agreements and deliveries of Cam-it, located at Eusebiusbuitensingel 41, 6828 HX Arnhem, registered under Chamber of Commerce (KVK) number 95565531.
1.2 By placing an order, the customer agrees to these general terms and conditions. These terms are available on the website and in printed form upon request.
1.3 Deviations from these terms are only valid if confirmed in writing by Cam-it. Other terms and conditions do not apply unless agreed in writing.
1.4 Cam-it reserves the right to amend the general terms and conditions. Customers will be informed of changes in good time.
Article 2: Offer and agreement
2.1 All offers on the website are without obligation and may be revoked at any time, even if they have been confirmed.
2.2 An agreement is concluded when the customer places an order and it is confirmed by Cam-it via email. The confirmation contains details of the order, the price, the expected delivery time and the payment terms.
2.3 Cam-it has the right to refuse orders or request additional information before confirming the agreement. This may be the case with incomplete or incorrect information.
2.4 Cam-it will inform the customer of any changes to the offer and delivery, such as changes to delivery times or availability.
Article 3: Prices and payments
3.1 All stated prices are in euros, including VAT and other levies, unless stated otherwise. Cam-it reserves the right to change prices. The prices applicable at the time of ordering apply.
3.2 Payment can be made via the payment methods available on the website, including iDEAL, credit card, Maestro, MasterCard, Visa, American Express, Bancontact, Google Pay, Apple Pay, UnionPay and PayPal.
3.3 The customer is obliged to make payment within the set period. If payment is not made on time, Cam-it reserves the right to cancel the order or suspend delivery.
3.4 In the event of late payment, Cam-it may charge statutory interest and collection costs in accordance with statutory provisions. The customer is liable for the costs arising from the collection.
3.5 If the customer chooses a payment method with additional costs, such as a buy-now-pay-later service, the customer is responsible for paying these costs.
Article 4: Delivery
4.1 Delivery of the products takes place at the address provided by the customer. The customer is responsible for providing correct and complete address details.
4.2 The delivery time is on average 2 working days, unless stated otherwise. Cam-it is not liable for delays in delivery, unless these are due to intent or gross negligence.
4.3 The customer is obliged to check the delivered products upon receipt for any damage, incorrect products or other defects. Any complaints must be reported to Cam-it in writing within 7 days of receipt.
4.4 If a product is not available, Cam-it will inform the customer and offer an alternative or cancel the order. Cam-it is not liable for any damage resulting from an unavailable product.
4.5 Deliveries take place within Europe. Additional shipping costs for international shipments are clearly stated during the ordering process.
4.6 Responsibility for the product passes to the customer at the time of delivery. The customer is liable for damage to or loss of the product after receipt.
Article 6: Warranty
6.1 The delivered products come with a 24-month warranty, unless stated otherwise in the product description.
6.2 The warranty covers defects that occur within the warranty period, provided the product has been used and maintained correctly, as described in the supplied user manual.
6.3 Customers must report defects to Cam-it in writing within 7 days of discovery. The customer must return the product in its original packaging together with a copy of the proof of purchase.
6.4 If a product becomes defective within the warranty period, the customer is entitled to repair, replacement or a refund, depending on the situation and the possibilities. In the case of replacement, Cam-it may offer an equivalent product.
6.5 The warranty lapses if the customer carries out modifications or repairs to the product themselves, or if the product has been exposed to incorrect use or careless maintenance.
6.6 Cam-it is not liable for damage resulting from use of the products in combination with other products not recommended by Cam-it.
Article 7: Liability
7.1 Cam-it is not liable for indirect damage, consequential damage or damage caused by incorrect use of the products. This includes, but is not limited to, damage to vehicles, other goods or persons.
7.2 Cam-it's liability is limited to the amount the customer paid for the product in question, unless there is intent or gross negligence.
7.3 Cam-it is not responsible for damage caused by incorrect use, installation or mounting of the products. The customer is responsible for following the instructions and guidelines supplied with the product.
7.4 In the event of damage to the customer or third parties resulting from use of the products, the customer indemnifies Cam-it against all third-party claims.
7.5 Customers are encouraged to contact Cam-it if in doubt about the suitability of a product for their specific situation.
7.6 Cam-it is not responsible or liable for any damage to vehicles, parts or accessories resulting from the installation or mounting of the supplied dashcams. Customers are advised to have the installation carried out by a professional installer or to carefully follow the supplied manual and installation instructions.
Article 9: Applicable law and disputes
9.1 These general terms and conditions and all agreements are governed by Dutch law.
9.2 Disputes arising from or related to these terms or the agreement will be submitted to the competent court in Gelderland, unless mandatory law provides otherwise.
9.3 Cam-it will strive to resolve disputes by mutual agreement. Customers are encouraged to contact customer service first before taking legal action.
9.4 For disputes relating to the application of these general terms and conditions, the Dutch version of these terms shall prevail.
Article 10: Amendments
10.1 Cam-it reserves the right to amend these general terms and conditions. Amendments will be announced on the website and apply to new orders from the date of publication.
10.2 Customers are advised to consult the general terms and conditions regularly for any changes.
Article 11: Customer service
11.1 For questions, comments or complaints, the customer can contact Cam-it customer service via Info@cam-it.com or via the chat function on the website.
11.2 Cam-it aims to respond to questions and complaints within 3 working days.
11.3 Customers can also use the FAQ section on the website for frequently asked questions.
Article 12: Other provisions
12.1 If any provision of these general terms and conditions proves to be invalid or unenforceable, the remaining provisions shall remain in full force.
12.2 These general terms and conditions have been drawn up in Dutch. In the event of translations into other languages, the Dutch text shall prevail.
12.3 Customers may save and/or print these terms for their own records.
Article 13: Intellectual property
13.1 All intellectual property rights relating to the products and the website of Cam-it, including but not limited to copyrights, trademark rights and database rights, are vested in Cam-it or its licensors.
13.2 The customer is not permitted to reproduce, publish or distribute any information, images or texts from the website without written permission from Cam-it.
13.3 The customer acknowledges that Cam-it's products and services represent unique and valuable intellectual property rights and will refrain from any infringement thereof.
Article 14: Force majeure
14.1 Cam-it is not liable for any delay or shortcoming in the performance of the agreement if this is due to force majeure. Force majeure means any circumstance that prevents the performance of the agreement and that cannot be attributed to Cam-it.
14.2 In the event of force majeure, Cam-it will inform the customer as soon as possible of the cause and the expected duration of the force majeure.
14.3 If the force majeure situation lasts longer than 6 weeks, the customer has the right to dissolve the agreement free of charge.
